Ormanların ülke ekonomisine, su ve toprak rejimine, iklim ve sağlık üzerine olumlu katkıları vardır. Ülkemizde ormanlar genelde devletin mülkiyetindedir. Ancak, % 1’i özel mülkiyettedir. 6831 sayılı Orman Kanunu, özel mülkiyet konusu bu ormanlarla ilgili bir takım sınırlamalar getirmektedir. Yine adı geçen bu Kanunla, özel orman maliklerine bir takım yükümlülükler getirilmiştir. Ormanlar taşıdıkları önem sebebiyle diğer taşınmazlardan farklı bir mülkiyet rejimine tabi tutulmuşlardır. Özel ormanlarda tam ve gerçek manada mülkiyet hükümleri uygulanmaz. Forests have affi rmative effects on economy, water and soil regime, climate and health of a country. The forests in our country are under ownership of the state in general. However, 1% thereof is owned by private sector. Forestry Law no. 6831 stipulates some restrictions regarding the forests of private ownership. The said Law also stipulates some liabilities imposed on private forest owners. Because of their importance the forests have been subjected to an ownership different from ownership of other immovable properties. Full and actual ownership provisions are not applied to private forests. |
