Bu sürece bir taraftan Avrupa yurttaşları değişik şekillerde, diğer taraftan da Avrupa Birliği ve organları anlaşmaların akdi ve değişik-likleri üzerinden katkı yapmaktadır. Bu nedenle AB’de anayasallaş-ma sürecinde karma bir anayasa yapıcı güçten söz edilmektedir. Makalede AB’de anayasallaşma sürecine esas olan karma karakter başlangıçtan günümüze dek dönemeç teşkil eden anlaşma değişik-likleri ışığında incelenmektedir. On the one hand, European citizens contribute to this process in different ways, on the other hand, the European Union and its organs contribute to this process through adoption and amend-ment of treaties. For this reason, it is discussed that there is a mixed constitution-making power in the constitutionalization process in the EU. This article examines the mixed character, as the basis of the constitutionalization process in the EU, in the light of the treaty amendments that constitute a turning point from the beginning to the present. |
