Özet
Giyilebilir teknolojik ürün terimi, insan bedeninin üzerinde taşınan (bazı durumlarda içine takılan) ve kişilerin kıyafet ya da aksesuarlarına yerleştirilen bilgisayarları ve diğer elektronik cihazları tanımlamak için kullanılmaktadır. Günümüzde giyilebilir teknolojik ürünlerin neredeyse tamamı, bunları barındıran kişinin, çeşitli kişisel verilerini elde etmekte ve bu verileri saklanması için merkezi bir bilgisayar yazılımına göndermektedir. Bu yöntemle işlenen kişisel veriler, kişinin sportif faaliyetlerine (adım sayısı, kat ettiği mesafe, egzersiz ve aktivite düzeyi vb.) ; bulunduğu konuma (GPS verileri, yükseklik, basınç çevresel ses ve ışık düzeyi ve hava kalitesi vb.) veya sağlığına ve yaşam tarzına (nabız, beden sıcaklığı, kan basıncı, solunum hızı, oksijen seviyesi, kan şekeri ve uyku düzeni vb.) yoğunlaşmaktadır. Görüleceği üzere, giyilebilir teknolojik ürünler aracılığıyla işlenen kişisel verilerin büyük bir kısmı, kişisel sağlık verileri ekseninde yoğunlaşmaktadır. Kişisel sağlık verileri, Kişisel Verilerin Korunması Kanunu (KVKK) ve Avrupa Birliği Genel Veri Koruma Tüzüğü’nde (GVKT) özel nitelikli (hassas) kişisel veriler arasında kabul edilmiş ve hukuka uygun işlenmeleri, diğer kişisel verilerden farklı kurallara tabi kılınmıştır. Bu nedenle veri sorumluları, giyilebilir teknolojik ürünler aracılığıyla gerçekleştirilen işleme faaliyetlerinde, kişisel sağlık verileri konusunda hukuka uygunluk sebeplerinin belirlenmesi ve genel ilkelere uygun işleme yapılması konusunda diğer verilere kıyasla daha da özenli davranmak zorundadırlar.

The term wearable technological products refer to computers and other electronic devices that are carried on the human body (and in some cases implanted) and integrated into a person’s clothing or accessories. Today, almost all wearable technological devices collect various personal data from the individuals who use them and transmit this data to a central computer system for storage. The personal data processed through this method typically relate to the individual’s physical activities (such as step count, distance covered, level of exercise and activity, etc.) ; geographic location (such as GPS data, altitude, barometric pressure, ambient noise and light levels, air quality, etc.) ; or health and lifestyle (such as heart rate, body temperature, blood pressure, respiratory rate, oxygen levels, blood glucose, sleep patterns, etc.). As can be seen, a significant portion of the personal data processed via wearable technological devices focuses on personal health data. Personal health data are classified as special categories of personal data (also referred to as sensitive personal data) under both the European Union’s General Data Protection Regulation (GDPR) and the Turkish Personal Data Protection Law (PDPL). The processing of such data is subject to stricter legal requirements compared to other types of personal data. For this reason, data controllers must exercise greater care in identifying legal bases for processing and ensuring compliance with general principles when processing personal health data through wearable technological products.
